Commitment to Data Privacy
Personal data refers to any information relating to an identified or identifiable person, such as your name, date of birth, email address, postal address, or telephone number. Information that cannot be used to identify you specifically, such as the number of users of a website, is not considered personal data.
In principle, we will process your personal data only in accordance with applicable data protection laws, especially the European General Data Protection Regulation (“GDPR”), and only as described in this privacy policy. However, we reserve the right to process this data for additional purposes as permitted or required by law, or for supporting legal or criminal investigations. In such cases, we will inform you again about this additional data processing as required by law and obtain your consent if necessary.
User Identification and Account Setup
User identification or activation through prior registration may be required on our website, for example, to access sections exclusively for Healthcare Professionals. During registration, you may need to provide your name, email address, postal address, login details, and proof of being a Healthcare Professional.
We process and store the personal data provided during registration solely to enable your access to and use of the website. The legal basis for processing your personal data is Article 6(1)(b) GDPR.
Contact Requests
When making inquiries through our contact form, you may be required to provide your name, address, email address, telephone number, reason for contact, and message.
We process and store the personal data provided during contact inquiries solely to process your request, respond to it, and communicate with you.
The legal basis for processing your personal data is the fulfillment of our contractual obligations (Article 6(1)(b) GDPR) or our legitimate interests, particularly in contacting you and communicating about the specific matters you have contacted us for (Article 6(1)(f) GDPR).
Orders and Services
When ordering products and services through the website (such as informational materials, brochures, training, etc.), you may be required to provide your name, email address, postal address, login details, and proof of being a Healthcare Professional.
We process and store the personal data provided during the ordering process solely to provide you with the ordered products and services. The legal basis for processing your personal data is Article 6(1)(b) GDPR.
Adverse Event Reporting (Vigilance Reports)
CLS Labeling Support eK is obligated on behalf of CHEPLAPHARM to report adverse events, lack of drug efficacy, quality complaints, and/or other aspects related to the safety or quality of CHEPLAPHARM products. This obligation extends to medical devices distributed or supplied by CHEPLAPHARM.
Therefore, we are required to review communications on our website (e.g., as part of a contact inquiry to us) for vigilance reporting. If you provide us with information regarding CHEPLAPHARM products, including information about your health status, adverse events, and possibly your name, we will transmit this information to CHEPLAPHARM for these purposes. As part of this process, CHEPLAPHARM may contact you for further clarification.
The legal basis for processing your personal data is the public interest in public health to ensure high quality and safety standards in healthcare and pharmaceutical products (Article 9(2)(i) GDPR in conjunction with Section 22(1)(c) BDSG).
Disclosure of Personal Data
CLS Labeling Support eK will not disclose or otherwise disseminate your personal data to third parties unless necessary for the performance of our services (legal basis for processing: Article 6(1)(b) GDPR), you have consented to such disclosure (legal basis for processing: Article 6(1)(a) GDPR), or disclosure of data is permissible under relevant legal provisions.
CLS Labeling Support eK is entitled, within the framework of data protection regulations, to outsource the processing of your personal data in whole or in part to external service providers acting as processors for CLS Labeling Support and/or CHEPLAPHARM pursuant to Article 4(8) GDPR. External service providers assist us, for example, in technical operation and support of the website, data management, provision and delivery of services, marketing and website analytics, as well as the execution and fulfillment of vigilance reporting obligations. The service providers engaged by CLS Labeling Support eK and/or CHEPLAPHARM process your data exclusively in accordance with our instructions.
Personal data may also be processed and disclosed to third parties in other ways if required by law—e.g., by court order or to fulfill legal obligations such as official vigilance regulations—or if necessary to support criminal or legal investigations or other legal proceedings or investigations domestically or internationally, or to safeguard legitimate interests (legal basis for processing: Article 6(1)(c) and (f) GDPR), such as providing joint content, products, and services.
Retention Period
We will store your personal data only for as long as necessary to achieve the purposes for which the data was collected or, where additional statutory retention periods exist (e.g., under commercial law or tax law), for the duration of the legally prescribed retention period. After this period, your personal data will be deleted by us. In exceptional cases, your data may be stored beyond this period if, for example, storage is necessary for the establishment, exercise, or defense of legal claims on behalf of CLS Labeling Support and/or CHEPLAPHARM.
Your Data Privacy Rights
Subject to applicable data protection law, you have the following rights:
Right to information, correction, deletion, and restriction: You have the right to obtain information about your personal data stored by us at any time. If we process or use your personal data, we strive to ensure through appropriate measures that your personal data is accurate and up-to-date for the purposes for which it was collected. If your personal data is incorrect or incomplete, you may request the correction of this data. Furthermore, you may have the right to request the deletion or restriction of processing of your personal data if, for example, such processing no longer serves a legitimate business purpose according to this privacy policy or applicable law, and statutory retention obligations do not require further storage.
Right to data portability: You may have the right to receive the personal data concerning you that you have provided to us in a structured, commonly used, and machine-readable format, or to transmit this data to another controller.
Right to revoke your consent: If you have consented to the collection, processing, and use of your personal data, you may revoke your consent at any time with effect for the future. However, the legality of the processing carried out based on the consent until the revocation is not affected.
Right to object pursuant to Article 21(1) and (2) GDPR: You have the right to object at any time, for reasons arising from your particular situation, to the processing of your personal data based on Article 6(1)(e) or (f) GDPR. We will not process your personal data after objection, unless we can demonstrate compelling legitimate grounds for processing that outweigh your interests, rights, and freedoms, or the processing serves the establishment, exercise, or defense of legal claims (see Article 21(1) GDPR, so-called “limited right to object”). In this case, you must provide reasons for the objection based on your particular situation.
